Informational letter affirms constitutionality of nativity scenes in public Christmas celebrations
GREEN BAY, Wis. — Attorneys with the Alliance Defense Fund sent a letter Monday to Green Bay city officials, affirming the constitutionality of the city’s holiday display at City Hall and offering to defend it in court free of charge. The Freedom From Religion Foundation, a secularist group, demanded that city officials remove a nativity scene from the display or face possible legal action.
“The American people, common sense, and the U.S. Constitution are clearly winning the war on Christmas. These battles against Christmas are out of touch with the 95 percent of Americans who celebrate Christmas. Such attacks are simply part of a larger war that the secular Left is waging on all things Christian,” said ADF Senior Counsel Gary McCaleb.
Green Bay’s city council president, acting as a private citizen, received permission from the mayor to place a nativity scene on one of the overhangs at the entrance to City Hall. A Wiccan group has placed a wreath on the overhang, next to the nativity scene.
The Freedom from Religion Foundation has also objected to a nativity scene display in the town of Peshtigo. ADF attorneys sent a letter offering to defend that town on Thursday (www.telladf.org/news/story.aspx?cid=4327). The organization’s view was summarized in a media interview on an unrelated Christmas situation in Wisconsin, when Annie Laurie Gaylor of the Freedom From Religion Foundation said, “The state of Wisconsin cannot have a Christmas anything.”
